2015 Police Firing case in Trial Court: Snr. Advocate R.S. Bains Appointed as Special Prosecutor

Rajwinder Singh Bains, Senior Advocate, Punjab and Haryana High Court, has been appointed as Special Prosecutor to prosecute the government.

Punjab government has appointed Rajwinder Singh Bains, a senior advocate of the Punjab and Haryana High Court, as Special Prosecutor to prosecute the four cases of violence and police firing following the incidents of indecency in 2015.

Advocate appearing in Behbal Kalan Golikand case, next hearing on October 29

During the hearing of the Behbal Kalan Golikand case in the court here, senior advocate RS Bains, appointed by the Punjab Government to prosecute indecency cases and related Golikand cases, appeared. However, defense counsel objected to his appearance as a public prosecutor during the hearing, while public prosecutor RS Bains said the court had full authority to allow the hearing. Although he has been counsel for the complainant in the Kotkapura case, his work has not changed. Earlier, he was pursuing the same case for the complainant. He will now pursue the cases as a public prosecutor.

Despite 42 hearings, the charges have not been settled yet

He said that the defense had filed an application in the court today seeking some copies of the challan. The accused wanted to prolong the case by filing such petitions using force as the charges have not been decided despite 42 hearings.

The purpose of their visit was to get the court to reconsider. He urged the court to expedite the hearing of the case as the sentiments of people were involved. He said that so far he has received four cases in which two Kotkapura and two Bajakhana police station registers have come for his prosecution.

Few month before, the Punjab and Haryana High Court not only gave former Chief Minister Parkash Singh Badal a clean chit in the Kotkapura firing case but also ruled that the conclusion of the police firing without provocation was contrary to the record.

The new SIT will complete its six-month probe on November 7, so the truth must come out.

He said that so far he has received four cases in which two Kotkapura and two Bajakhana police station registers have come for his prosecution. The new bench is expected to file its report in the court soon. Against whom we objected that he could not pursue the case as a public prosecutor during the court hearing as he was already pursuing the case in the High Court on behalf of the complainant in FIR No. 129 registered in Kotkapura.

Therefore, he cannot pursue the case as a public prosecutor. “Some of the copies of our application were executed in the court today,” he said. He appealed to us to provide them, which we have received today. The next hearing has not been announced yet.

All the nominees including suspended IG Paramraj Singh Umranangal, former SSP Charanjit Sharma and SP Bikramjit Singh appeared in the court. As per today’s court proceedings, copies of charge sheets were provided to all accused. The next hearing is scheduled for October 29, 2021. Charges may be framed against the accused named on October 29.

While Ex IPS Kunwar Vijay Pratap who was part of the SIT investigating the 2015 Kotkapura firing case in Punjab, joined the Aam Aadmi Party on June 22, 2021, Delhi’s chief minister, Arvind Kejriwal, greeted him as “my officer Bhai (my officer brother)”.

Opposition lawyer RS ​​Bains objects to Behibal Kalan shooting

Now even Sidhu’s resignation has been rejected by the High Command. Now when advocate RS Bains reached the court in Faridkot as a PP to pursue the case, the defense counsel of the opposition objected to him. “It’s up to the opposing lawyer to do that and they can,” Bains said. He said the Opposition’s counsel had submitted a letter and some other documents to the court objecting to his presence.

Trust new SIT to ensure justice to Kotkapura victims and the innocents

The final decision rests with the court. He said that the opposition wanted to use its influence to prolong the case and already 42 hearings have been held in this case but no conclusion has been reached so far. “I will request the court to expedite the matter by giving a date as soon as possible as the sentiments of many people are attached to the matter,” he said.
